The following terms and conditions form an integral part of this contract and no variation shall be effective unless agreed by both Howard Lucas | Photographer and the Client in writing.
Booking fee: A non-refundable booking fee of £500 is required at the time of booking together with a signed contract (unless the total job price is less than £500 then the total is required). Dates are reserved once the booking fee and signed contract has been received and counter-signed. Funds can be transferred direct to Howard Lucas Limited, Santander bank, S/C 09-01-27, A/C No 95546168 or via Paypal.
Balance Payment: Balance of the outstanding amount is to be received by Howard Lucas | Photographer no later than 30 days before the booking date. Payments for additional prints after the booking date will need to be paid for when ordered.
Fees: The minimum total fee due is (SEE TOTAL ABOVE) of which the booking fee is part. This includes all items in the summary above. Further pictures will be available at £20.00 each.
Creative Licence: Creative and artistic licence shall be granted to Howard Lucas. His choice on Location, number of pictures and poses shall be deemed correct. The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Due to the vagaries of the weather and the willingness of the subjects it may not be possible to capture all the images requested. Special requests are not binding instruction although Howard Lucas will do his best to honour requested photographs but does not undertake to guarantee a specific picture. Any special requests must be made in writing by the client.
Viewing: A mutually agreed convenient appointment for viewing (this may be an online viewing) shall be made after the booking date. You can make your selection at this time .
Images: All image sizes are nominal. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record the exact colour as seen by the human eye.
Copyright: Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by The 1998 Copyright, Designs and Patents Act. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means and image created as part of this contract without the permission of the photographer in writing.
Digital Files: Digital files remain the property of the photographer.
Exclusivity: Howard Lucas shall be the sole professional stills photographer at the venue specified.
Force Majeure (or Act of God): The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Photographer: On occassions and without notice it may be necessary for the photographer originally specified to be substituted by another photographer (e.g due to ill health). This substitution will be of the same calibre as the originally requested photographer.
Cancellation: If Howard Lucas | Photographer has to cancel this contract for reasons beyond their control, (death, injury, sickness etc) their liability shall be limited to a full refund of all monies.
The client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. In addition, as compensation for loss of Income, Howard Lucas | Photographer will apply the following charges as a percentage of the total fee due.
Number of days before the wedding
60 days or less 100%
61-90 days 75%
91-120 days 50%
Should the cancelled wedding date be a postponement, then subject to availability all money paid may be applied to the new wedding date.
Where the photographer is able to rebook the date with an equivalent booking, the cancellation fee will be reduced to the non-refundable booking fee only and any additional cancellation fees already paid will be refunded accordingly.
For bookings completed entirely by distance means (telephone/website/email) under The Consumer Protection (Distance Selling) Regulations 2000 you have the right to cancel the contract within seven days (starting the day after the contract is signed). You have the right to cancel for any reason without penalty. Display: The client hereby allows the photographer to display any images included in this contract in their studios, portfolios, literature, exhibitions and advertising including online. No use of the images will be made by the photographer for other commercial reason except with the written permission of the client.
Limitation of Liability: In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Complaints: Any complaints should be raised by the client with the photographer, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days or receipt of the images.
Privacy: Howard Lucas | Photographer will store your name and event details on a private internal database. these details will not be made available to any companies or individuals outside Howard Lucas | Photographer.

I have read this booking form and agree to abide by the terms of agreement set out in it. I understand that the terms of this agreement cannot be changed unless agreed by both parties in writing.
